PUBLIC OFFER (CONTRACT) FOR THE USE OF THE DEKUVE PROJECT'S OPERATING SYSTEM AND ITS SOFTWARE

Between Denys Kulbii, hereinafter referred to as the "Developer," and users (hereinafter referred to as "Users"), who acknowledge themselves as individuals interacting with the DEKUVE software, including but not limited to downloading, installing, using, studying, distributing, or making changes to the DEKUVE software. The User acknowledges being a full-fledged participant in the DEKUVE ecosystem and agrees to the terms presented in this agreement.

1. SUBJECT OF AGREEMENT:

The Developer provides Users with access to the DEKUVE software (hereinafter the "Distribution") under the terms of this agreement.

2. DEKUVE WILL REMAIN 100% FREE:

DEKUVE is a project based on the principles of free software (FS). This means:

2.1. Freedom to Use: All users have the right to use DEKUVE Distribution freely and without restrictions.

2.2. Freedom to Study: Users have access to the source code of DEKUVE Distribution and can study it for their needs.

2.3. Freedom to Distribute: Users can freely distribute copies of DEKUVE Distribution, contributing to the dissemination of free software.

2.4. Freedom to Modify: Users have the right to make changes to the source code of DEKUVE Distribution and create their own versions of the system. DEKUVE strives to uphold and promote freedom in the use, study, distribution, and modification of software. We commit to maintaining these principles and remaining fully free software.

3. USER OBLIGATIONS:

3.1. Users undertake to use the Distribution in accordance with laws and ethical standards.

3.2. The Developer does not collect Users data. Users are responsible for maintaining the confidentiality of their account data.

4. LIABILITY TO USERS:

The Developer is not responsible for any direct, indirect, incidental, or other losses arising from the use or inability to use the Distribution.

5. INSTALLATION AT USER'S OWN RISK:

Users install the DEKUVE Distribution at their own risk. Neither party will be responsible for data loss, software damage, or other negative consequences resulting from the installation and use of the Distribution.

6. LICENSE AND ABSENCE OF WARRANTIES:

6.1. The Distribution is provided "as is" without any warranties, express or implied. The Developer makes no warranties regarding the fitness of the Distribution for specific purposes, its quality, or compliance with Users' expectations.

6.2. The project is provided under the GNU General Public License. Additional details are available in the corresponding license.

7. LIMITATIONS ON USER RIGHTS APPLICATION:

Users acknowledge and agree that consumer rights provided by the legislation of the European Union do not apply to relations between them and the Developer.

8. USER CONFIRMATION:

Users confirm that they have all necessary legal authority to use the Distribution and comply with the laws of their jurisdiction.

9. SANCTIONS LIMITATIONS:

Users confirm that they do not use the Distribution in countries or regions subject to US embargoes. They also assert that they are not included in sanction lists and do not violate the sanctions of Ukraine, the EU, the UK, or other countries.

10. DAMAGES COMPENSATION:

Users agree to indemnify the Developer for any losses arising from a breach of the specified conditions, including legal costs and fines.

11. AGREEMENT AND ACCEPTANCE OF TERMS:

The use of the Distribution implies full and unconditional agreement with the terms of this agreement.

12. CHANGES AND FINAL PROVISIONS:

12.1. The Developer reserves the right to make changes to the terms of the agreement without prior notice.

12.2. In case of disagreement with any provision of this agreement or if the use of the Distribution violates the laws of the User's jurisdiction or the terms of the agreement do not comply with the legislation of the User's country, the User undertakes to immediately cease downloading and using the Distribution for any purpose. Any actions by the User contrary to this provision may result in legal liability in accordance with applicable law. The Developer and other developers of the Distribution are not responsible for any consequences arising from the User's failure to comply with the above requirements and limitations.

12.3. This agreement is considered concluded, accepted, and effective from the moment of the User's start of downloading and/or use of the Distribution.
